Please read these Terms and Conditions (“Terms”) carefully. By accepting a Quote, placing an Order, or instructing EZE EV Chargers and Installation (“We”, “Us”, “Our”) to commence work, you (“Client”, “You”) agree to be bound by these Terms.

1. Definitions

Agreement – The contract formed when the Client accepts the Quote.

Charger – The EV charging unit supplied and/or installed by Us.

Premises – The location where the Services are performed.

Products – All goods, materials, and equipment supplied by Us.

Quote – The written document outlining scope, price, inclusions, and exclusions.

Services – The supply, installation, testing, commissioning, or maintenance of EV chargers.

Standard Installation – Installations meeting the criteria in Clause 4.2.

Non-Standard Installation – Installations requiring extra work, costs, or time under Clause 4.3.

Works – All Products and Services supplied.

2. Quotes, Acceptance, and Pricing

2.1 Quote Validity

Quotes are valid for 30 days unless otherwise stated.

2.2 Acceptance

You accept the Quote and these Terms by:

• Signing the Quote

• Providing written or verbal approval to proceed

• Completing the secure card confirmation process

• Allowing Us to commence the Works

2.3 Fixed Pricing & Variations

• The Quote provides fixed pricing for the agreed scope

• If unforeseen issues arise, including non-compliant wiring, limited access, structural barriers, or switchboard deficiencies, a Variation Quote will be issued

• Variation works will only proceed after approval

• Labour for approved variations is charged at Our standard hourly rate plus materials unless otherwise quoted

3. Payment, Card Confirmation & Cancellations

3.1 Booking Confirmation

To confirm and secure a scheduled installation booking, Clients may be required to complete a secure card confirmation process via Stripe. This authorises EZE EV Chargers and Installation to securely store the nominated payment method against the confirmed booking.

3.2 Payment Processing

No payment is taken at the time of booking confirmation unless otherwise agreed in writing.

The nominated payment method will only be charged:

• Once the scheduled Works have been completed

• Where cancellation, re-attendance, variation, or other agreed fees become payable under these Terms

3.3 Security

All card details and payments are processed securely via Stripe.

EZE EV Chargers and Installation does not directly store or access full card details.

3.4 Cancellation, Rescheduling & Customer Unavailability

Bookings cancelled or rescheduled with more than 24 hours’ notice will not incur a cancellation fee unless:

• Non-returnable stock has been ordered

• Permits or third-party services have been booked

• Custom materials have been allocated

Where a confirmed booking is cancelled, rescheduled, the Client is unavailable, the Premises cannot be accessed, or the required charger/equipment is not available within 24 hours of the scheduled appointment time, We may charge a cancellation or failed attendance fee of $176 including GST to cover technician allocation, administration, and travel costs.

3.5 Failed or Declined Payments

Where payment cannot be successfully processed on the nominated payment method after completion of the Works, We reserve the right to:

• Issue an invoice payable immediately

• Suspend future bookings

• Recover reasonable administrative and collection costs

• Recover any Stripe or merchant processing fees incurred from failed payment attempts where legally permitted

3.6 Title & Risk

Risk in supplied Products transfers upon delivery to the Premises.

Title in supplied Products remains with EZE EV Chargers and Installation until full payment has been received.

4. Scope of Works, Access, and Client Responsibilities

4.1 General Scope

All installations comply with AS/NZS 3000, manufacturer requirements, and applicable Energy Safe Victoria regulations.

A Certificate of Electrical Safety (COES) will be issued upon completion where required.

4.2 Standard Installation Conditions

Standard Installation applies only where:

• The property is safely accessible

• Charger location is within the quoted cable distance

• The switchboard has adequate capacity and compliant protection

• No trenching, civil works, switchboard upgrades, or specialist access equipment is required

• Clear access is available

4.3 Non-Standard Installation

Works may be paused where:

• Electrical infrastructure is unsafe or non-compliant

• Additional labour is required

• Trenching, fire-rated penetrations, switchboard upgrades, or structural modifications are required

A Variation Quote will be issued before continuation.

4.4 Site Access and Conditions

The quoted price assumes reasonable access, meaning:

• Safe and unobstructed access to switchboard and charger location

• Cable routes accessible through wall cavities, roof spaces, or subfloors

• Working heights safely reachable by standard ladder access up to 3.6m

• Cable runs within quoted allowance

Restricted or unreasonable access includes:

• Unsafe switchboard locations

• Confined roof or subfloor spaces

• Scaffolding, EWP, or roof safety equipment requirements

• Concealed structural barriers or hidden services

If restricted or unsafe access is identified, a variation may be issued before continuing.

4.5 Client Responsibilities

The Client must:

• Obtain landlord, strata, or body corporate approval where required

• Provide clear access to all work areas

• Ensure charger, vehicle, and site are ready where client-supplied

• Disclose known hidden services

We are not liable for unknown concealed services.

5. Electrical Capacity and Suitability

The Quote assumes the existing electrical supply and switchboard are suitable.

Where insufficient capacity, defects, or compliance issues are identified, a separate upgrade quote may be required before installation proceeds.

6. Warranties and Liability

6.1 Product Warranty

Products are covered by manufacturer warranty.

6.2 Workmanship Warranty

Our workmanship is warranted for 3 years, excluding misuse, environmental damage, or pre-existing defects.

6.3 Client-Supplied Chargers

Our warranty covers installation workmanship only.

6.4 Australian Consumer Law

Nothing in these Terms excludes rights under Australian Consumer Law.

6.5 Limitation of Liability

Our total liability is limited to the amount paid for the relevant Services.

We are not liable for indirect or consequential loss.

7. Safety, Suspension & Termination

7.1 Safety and Suspension

Works may be paused if site conditions are unsafe or non-compliant.

7.2 Termination

We may terminate the Agreement if:

• Payment is not made

• Required safety rectifications are declined

• Site access remains unsafe

• The Client becomes insolvent

8. Installation Timeframes

Estimated installation durations:

• Basic installation: 1–2 hours

• Standard installation: 2–4 hours

Additional time may be required for switchboard issues, structural barriers, or cable route changes.

9. General

• Governed by the laws of Victoria, Australia

• We comply with Australian Privacy Principles

• We hold public liability and electrical contractor insurance

• We may use licensed subcontractors where required
